The Rosehill Estate, Kells Road, Kilkenny, has been the subject of four separate planning permissions dating from 2004 and one application for retention permission currently before Kilkenny County Council for assessment. There is also an active planning enforcement file in relation to non compliance with some conditions of the planning permission and a Section 5 Referral made by the Residents Association to An Bord Pleanala for adjudication in relation to floor levels of permitted housing units.
On the 10th November 2011 the Rosehill Residents Association made an application for a Section 160 Planning Injunction in the Circuit Court against the Developers, Castlelands Construction, Hallmark Building and Civil Engineering Ltd., and John and Elaine Barry the owners of the Rosehill lands.
This related to restraining the developers from undertaking unauthorized works, seeking compliance with the terms of the existing planning permissions and completion of the roads, services and common areas of the Rosehill Estate. On 20th December, 2011 Kilkenny County Council was formally joined as a co-respondent in these proceedings. These proceedings have been adjourned to 23rd March, 2012.
The 27 housing units currently under construction by the developers of the estate, by way of Building Agreement with Kilkenny County Council, are to fulfill the requirement on the developer under their planning permission to provide Part V Social and Affordable housing units. In addition the County Council will pursue the developer under the planning enforcement provisions of the Planning and Development Acts to ensure the satisfactory completion of the overall development in accordance with the planning permissions granted.
